YOU HAVE A RIGHT TO REMAIN SILENT WHEN ARRESTED UNTIL YOU SEE A LAWYER?

Section 35(2) of the 1999 Constitution states:

‘Any person who is arrested or detained shall have the right to remain silent or avoid answering any question until after consultation with a legal practitioner or any other person of his own choice.’

DID YOU ALSO KNOW THAT…?

Whenever a person is arrested, he/she is entitled to be given an avenue for obtaining legal advice, access to communication for release or defence.

Section 14(2) Administration of Criminal Justice Act 2015 provides;

‘A person who has the custody of an arrested suspect shall give the suspect reasonable facilities for obtaining legal advice, access to communication for taking steps to furnish bail and otherwise making arrangements for his defence or release’
